Privacy Policy

Last Updated: 9 October 2026

KinkySydney (“KinkySydney”, “we”, “us” or “our”) operates kinkysydney.com (the “Website”), an online community for adults aged 18 and over. The Website hosts user-generated content, including sexually explicit images, videos, stories and discussions. KinkySydney is a small, independently operated website.

This Privacy Policy explains how we collect, use, disclose, store and protect personal information. Information connected with an adult community can be especially sensitive. Disclosure could reveal a person’s sexual interests, relationships or identity, so we aim to collect only what we need and to handle it carefully.

We handle personal information in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) where it applies to us. As a small operator we may not be legally bound by the Australian Privacy Principles (APPs), but we choose to handle personal information in line with them.

This policy tells you about our practices. It is not a blanket consent to every collection, use or disclosure of your personal information. Where the law requires your consent, we will ask for it separately.

Please read this policy alongside our Terms and Conditions, Acceptable Use Policy and Cookie Policy.

1. What Personal Information We Collect

1.1 Types of Personal Information. Depending on how you use the Website, we may collect:

  • Account Information: your username and email address; login and authentication information (passwords are stored only as a secure hash, never as plain text); profile information you choose to provide; your account status, including whether you have completed age verification; and account security and administrative records. If two members link their accounts as a couple, some profile details, bio text and verification status are shared between the linked accounts.
  • Age Verification Information: to confirm you are 18 or older, you submit an image of an acceptable proof-of-age document (such as a driver licence, passport or proof-of-age card). We read the information needed to assess your age eligibility, mainly your name and date of birth. You may cover document details that are not needed, such as your address, document number and photo identifiers. Automated document reading does not by itself establish that a document is authentic or belongs to you. Verification outcomes and related records are kept as described in Section 8. We do not accept or collect credit card details for age verification.
  • Consent Verification Information: where content depicts other people, we may collect evidence of their age and their consent to publication. This may include documents provided by the uploading member or by the person depicted, and records of consent disputes, withdrawal requests and content-removal decisions. This means we may hold personal information about people who are not members.
  • Payment Information: KinkySydney does not currently offer paid features and does not collect payment information. If paid features are introduced, this policy will be updated before payments are taken.
  • Usage Data: information about how you interact with the Website, such as IP address, device and browser type, pages visited and timestamps.
  • Cookies and Tracking Data: information collected through cookies and similar technologies, as described in Section 2.2 and our Cookie Policy.
  • Signup Source: if you arrive through a campaign link (for example, a QR code at an event), we record which campaign it was. If you then register, that source is saved to your account.
  • Marketing and Communication Preferences: whether you have unsubscribed from member emails, the date you did so, and related records we keep to comply with the law. We do not track whether emails are opened or links are clicked.
  • Communication Data: if you contact us (for example, at admin@kinkysydney.com), your contact details and the content of your message.
  • User-Generated Content: any personal information you include in profiles, photographs, videos, stories, posts or other content you publish.

1.2 Sensitive Information. Under Australian privacy law, information about a person’s sexual orientation or sexual practices can be “sensitive information”, which carries extra protections. Profile details, interests and content on the Website may reveal this kind of information. Other information connected with the Website, such as the fact that someone is a member, their username or their photos, may not meet the legal definition but could still cause serious harm if disclosed. Age-verification documents and consent records are not automatically sensitive information, but we treat them with similar care. We collect sensitive information only where the law permits, including with your consent where consent is required. We limit collection to what is reasonably necessary for legitimate and lawful purposes, and we apply safeguards suited to the risk. Accepting this policy or our Terms and Conditions is not consent to every collection of sensitive information.

1.3 Information from Third Parties. We may receive personal information about you from other people or organisations, including:

  • members who report another member, content or behaviour;
  • people asking us to remove intimate images or other content that depicts them;
  • members providing consent evidence about people shown in their photos or videos;
  • service providers that support Website security and age verification; and
  • regulators or law enforcement agencies, where relevant and lawful.

We handle information received from third parties in accordance with applicable privacy requirements.

2. How We Collect Personal Information

2.1 Direct Collection. We collect personal information directly from you when you:

  • create an account or update your profile;
  • complete age verification. Verification is mandatory before you can access member areas or age-restricted content, and is generally completed once per account. We may require further checks where reasonably necessary, for example if we suspect an account has been compromised or shared, if information appears inaccurate, if there is misuse, or if regulatory requirements change, as set out in our Terms and Conditions and Acceptable Use Policy;
  • provide consent evidence for content you upload, or respond to a consent query;
  • upload content or take part in the Website, for example in groups, forums and comments;
  • ask an authorised administrator to check your photos (see Section 8.4); or
  • contact us, or report content or behaviour.

2.2 Automated Collection. We use cookies and similar technologies for the purposes described in our Cookie Policy:

  • Essential purposes: keeping you logged in, managing sessions, protecting forms and accounts, and enforcing access restrictions.
  • Analytics: we use Koko Analytics, which runs on our own server and sets a first-party cookie to count visits and returning visitors. It does not share data with third parties.
  • Campaign source: a cookie called “ks_src” stores which campaign link you arrived from for up to 30 days.
  • Server and security logs: we record IP addresses and account activity to protect the Website and investigate misuse.
  • Photo matching: we create a digital fingerprint of profile, partner and gallery photos so we can spot the same photo being used on more than one account.

Some pages load fonts and code from third-party delivery services (Google Fonts and Cloudflare’s cdnjs), which receive your IP address and browser details when those files load. We do not use web beacons or advertising pixels.

2.3 Voluntary Submission. Some information is required and some is optional:

  • Required to create and secure an account: username, email address and password.
  • Required for age verification: a proof-of-age document. You cannot access member areas or age-restricted content until verification is complete.
  • Optional: most profile details, photos and other contributions. You can choose not to provide them.
  • Required in some investigations: information needed to look into consent or safety concerns.

If you do not provide required information, some features will not be available to you.

3. Why We Collect and Use Personal Information

3.1 Purposes of Use. We use personal information to:

  • operate the Website, including account management and hosting member content;
  • verify that members are 18 or older before they access member areas or age-restricted content;
  • verify the age of, and consent from, people depicted in user-generated content. These processes support compliance with applicable law and our own content standards;
  • respond to enquiries, complaints and reports of illegal or harmful content or behaviour, such as harassment or doxxing;
  • investigate disputed intimate content, consent withdrawal requests and content-removal complaints;
  • protect the Website and members from fraud, security threats and breaches of our Acceptable Use Policy;
  • understand how the Website is used, in aggregate, so we can improve it;
  • send essential account messages, and manage marketing preferences and send promotional emails where the law permits (see Section 3.3); and
  • respond to valid notices from the eSafety Commissioner and lawful requests from law enforcement within the timeframe set by law or stated in the notice.

3.2 Collection and Use of Personal Information. We collect, use and disclose personal information for lawful purposes connected with operating KinkySydney, subject to applicable Australian privacy laws. We do not use or disclose personal information for unrelated secondary purposes unless the law permits it. Where the law requires consent, we will seek it. Accepting this Privacy Policy or our Terms and Conditions is not blanket consent to every use or disclosure of your personal information.

3.3 Marketing Communications and Email Preferences.

Marketing communications. We may send emails about community news and updates, new Website features, groups, forums and events, and promotions or other activities we think may interest members. We send these emails only with consent, as required by the Spam Act 2003 (Cth). New members choose whether to receive these emails by ticking an option when they join. Members who joined before that option existed are asked to confirm or decline when they next log in, and until they answer we rely on consent that can reasonably be inferred from active membership. Creating an account does not by itself mean you have agreed to receive marketing.

Essential account communications. Some emails are needed to run your account, such as email verification, password resets, age-verification notices, security warnings, account restrictions and important changes to our policies or services. These are not marketing. If we add promotional content to one of these emails, Spam Act requirements may apply to it.

Unsubscribing. You can unsubscribe from marketing emails at any time. Every promotional email includes an unsubscribe link that works without logging in or providing extra information. Valid unsubscribe requests are actioned within five working days, and usually straight away. Unsubscribing does not affect your membership or the essential account emails described above.

Privacy protections. Our marketing emails identify KinkySydney as the sender. We do not sell or rent contact details to third-party marketers. We do not disclose information about your participation or interests for another organisation’s marketing without any consent the law requires. We keep limited records of consent and unsubscribe requests to show we are complying with the law.

4. How We Disclose Personal Information

4.1 Limited Disclosure. We do not sell or rent personal information. We may disclose it:

  • to hosting and technical service providers that run the Website, its email and its security, only as needed to provide those services;
  • to Microsoft Azure AI Vision for age-verification processing. When you submit a proof-of-age document, the image is sent to Microsoft to read the text on it, and the result is used to check your name and date of birth. Microsoft processes the image under its data processing terms;
  • to payment processors, only if paid features are introduced in future;
  • to regulators, courts or law enforcement agencies where disclosure is required or authorised by law, for example in response to a valid eSafety Commissioner notice or a lawful request;
  • to people involved in a content, consent or safety dispute, where disclosure is lawful and appropriate, for example telling someone that content they reported has been removed;
  • to protect people from harm. We may disclose information where we reasonably believe it is necessary to lessen or prevent a serious threat to someone’s life, health or safety, or to deal with suspected unlawful activity. Suspected child sexual exploitation material or other serious unlawful activity will be reported to the appropriate authorities. A suspicion that an account belongs to someone under 18 is handled under Section 9; and
  • to a successor operator if the Website is lawfully sold or transferred, subject to applicable privacy obligations.

4.2 Cross-Border Disclosure. The Website is hosted outside Australia. Our hosting provider stores the Website, its database (including account information, profile content and age-verification records) and its email in a data centre in the United States. Backups, where made, are also held by our providers outside Australia. Information may also be processed overseas when we use technical support or the content delivery services described in Section 2.2. Where we disclose personal information to an overseas recipient, we handle it in accordance with our obligations under the Australian Privacy Principles, including APP 8 where it applies. Storing information with a provider that only holds it for us may differ from disclosing it to a recipient that uses it for its own purposes. Using the Website does not mean you consent to overseas disclosure.

4.3 User-Generated Content. Personal information you include in profiles, photographs, videos, stories, posts and other content can be seen by other authorised members, according to the Website’s access controls and any visibility settings you choose. Please keep in mind:

  • Other people in your content. If your content shows or identifies another person, you must have their consent to publish it, as required by our Acceptable Use Policy.
  • Consent is specific. Consent to publish intimate material on the Website does not authorise any other use of it.
  • Removal requests. Anyone may ask us to remove content that contains their personal information or shows them without consent. Contact admin@kinkysydney.com. We will assess the request and may remove content while we investigate.
  • Disputes. Where consent is disputed or information has been disclosed without authorisation, we may ask the people involved for information and keep records of the dispute and our decision.
  • Copies. Members who can see content may be able to copy, screenshot or keep it. We cannot guarantee that published material will not be copied or redistributed, and deleting it from the Website may not remove copies others have made.

5. How We Protect Your Personal Information

5.1 Security Measures. We take reasonable technical and organisational steps to protect personal information, in proportion to its sensitivity and the risks involved. These include encrypted (HTTPS) connections to the Website, storage locations for identity documents and photo-check images that cannot be reached from the web, keeping software up to date, and account security controls. Access to sensitive administrative information, such as age-verification records, is limited to authorised administrators who need it for authorised purposes. No system is completely secure, and we cannot guarantee that information will never be accessed without authorisation.

5.2 Age Verification. Age verification uses the proof-of-age document you submit. Automated technology reads the relevant information on the document, mainly your name and date of birth. If the automated check is inconclusive or fails, an authorised administrator reviews your submission manually. Automated reading does not by itself establish that a document is authentic or belongs to you. Only authorised administrators can access submitted documents. Verification records are kept as described in Section 8. If you think your verification outcome is wrong, you can ask for it to be reviewed (see Section 5.5).

5.3 User Responsibilities. You must keep your login details secure and not share them with anyone, especially minors. Report any unauthorised access to admin@kinkysydney.com or by messaging @kinkysydney on the Website. You must not dox other people or disclose other members’ personal information. Doing so may lead to suspension or a ban, as set out in our Acceptable Use Policy.

5.4 Data Breach Response. If we suspect a data breach, we will assess it promptly and take reasonable steps to contain it and reduce harm. Where the Notifiable Data Breaches scheme applies and a breach is an eligible data breach, we will follow the scheme’s assessment and notification requirements, including notifying the Office of the Australian Information Commissioner (OAIC) and affected individuals. Not every security incident is a notifiable breach. We recognise that disclosure of intimate images, identity documents, membership information or other personal details could cause serious harm, and we may take further protective steps or notify affected people voluntarily where appropriate.

5.5 Automated Age Verification and Decisions. We use Microsoft Azure AI Vision to read text from identity documents submitted for age verification. The automated process works as follows:

  • Information used: the document image, and the name and date of birth read from it. These are compared with the legal name you entered and the minimum age of 18.
  • Purpose: to confirm that you are 18 or older before you can access member areas.
  • Decisions: if the date of birth shows you are 18 or older, the name matches and the reading is sufficiently clear, your account may be approved automatically, without a person reviewing it first. Automatically approved accounts may later be spot-checked by an authorised administrator.
  • Manual review: if the automated check cannot confirm your details, an authorised administrator reviews the submission. Decisions to reject a submission are made by an authorised administrator.
  • Limits: the technology reads text. It does not detect forged documents or confirm that a document belongs to you.
  • Photo matching: we also compare digital fingerprints of member photos to detect the same image on more than one account. Possible matches are referred to an authorised administrator, who decides what action, if any, to take.
  • Challenging an outcome: if you believe a verification or account decision is wrong, email admin@kinkysydney.com with your username and the reasons. An authorised administrator will review it.

6. Your Rights and Choices

6.1 Access and Correction. You can ask for access to the personal information we hold about you, or ask us to correct information that is inaccurate, out of date or incomplete. Email admin@kinkysydney.com from the address on your account, say what you are asking for, and include any evidence that supports a correction. We may need to confirm your identity before acting. Where the Privacy Act applies, you have rights of access and correction under APPs 12 and 13, subject to the exceptions in the Act. We will respond within a reasonable time. If we refuse a request or cannot fulfil it, we will explain why where appropriate and tell you how to complain.

6.2 Deletion. You can ask us to close your account or delete your personal information by emailing admin@kinkysydney.com. We will assess the request under applicable law. Information we no longer need for a lawful purpose will be deleted or de-identified where appropriate. Some records may need to be kept, for example for disputes, lawful investigations, security or legal obligations. Information deleted from our active systems may remain in backups for a period before it is overwritten. Content that other members have already lawfully accessed or saved may not be fully recoverable or removable. Australian privacy law does not give an unrestricted right to have all information erased in every circumstance.

6.3 Cookies and Tracking Preferences. You can manage or delete cookies through your browser settings. Essential cookies are needed for logging in and other core functions, so blocking them may stop parts of the Website from working. The Website does not currently have its own cookie-preference tool. If we add one, you will be able to use it as well. Where the law requires consent for a particular kind of tracking, we will ask for it. See our Cookie Policy for details.

6.4 Complaints. To make a privacy complaint, email admin@kinkysydney.com with:

  • your name or username and how to contact you;
  • what happened, including dates and links where possible; and
  • what outcome you are seeking.

Anyone affected by our handling of personal information can complain, including people who are not members. We will acknowledge your complaint, assess it, and may ask for more information. We will tell you the outcome and our reasons. If you are not satisfied, you may be able to complain to the Office of the Australian Information Commissioner (www.oaic.gov.au). Whether the OAIC can deal with a complaint depends on whether we are covered by the Privacy Act. Concerns about intimate images shared without consent, or other online harm, can also be reported to the eSafety Commissioner (www.esafety.gov.au).

7. Cookies and Tracking Technologies

7.1 Use of Cookies. We use cookies and similar technologies for Website functionality, authentication and login sessions, security, remembering member preferences, aggregate analytics through Koko Analytics, and recording campaign sources, as described in Section 2.2 and our Cookie Policy. Cookies help keep verified members logged in, but they do not establish or verify anyone’s age.

7.2 Cookie Preferences and Consent. You can manage most cookies through your browser settings. Where additional preference controls are provided, you can also use those. Where particular tracking requires consent under applicable law, we will ask for it. Our Cookie Policy has more information.

8. Retention of Personal Information

8.1 Retention Period. How long we keep personal information depends on the type of information, why we need it and what the law requires:

  • Account information: while your account is open, and afterwards only for as long as needed to deal with disputes, security issues or legal obligations.
  • Age-verification records: as set out in Section 8.3.
  • Consent records: for as long as the related content is on the Website, and afterwards while they may be needed to deal with a dispute or complaint.
  • User-generated content: until you or we remove it, subject to Section 6.2.
  • Complaints and moderation records: for as long as needed to deal with the matter, enforce our policies and respond to any related dispute.
  • Financial records: not currently applicable, because no payments are taken.
  • Security and email logs: account activity and security logs are kept for about three months. Copies of recent emails sent by the Website are kept in a rolling log of the most recent 250 messages.
  • Backups: information in backups is removed as those backups expire under our hosting arrangements.

8.2 Deletion After Retention. When we no longer need personal information for a lawful purpose, we securely delete it or de-identify it, unless the law requires us to keep it. Deletion from active systems happens first. Copies in backups are removed as those backups expire. Information held by service providers is deleted under their own arrangements. Records we must keep for legal or security reasons are kept separately until they are no longer needed. We cannot guarantee that information is removed from every system immediately.

8.3 Age Verification Evidence. Uploaded proof-of-age images are deleted after an authorised administrator has reviewed the submission. Images awaiting review are deleted after 30 days if they have not been reviewed. After deletion we keep only the verification outcome, your verified legal name and date of birth, the date and method of verification, and a record of the reviewer’s decision, for as long as your account exists.

8.4 Photo Checks. If you ask an authorised administrator to verify your profile or gallery photos, the check photo you send is seen only by authorised administrators and is deleted once a decision is made. We keep only the outcome, the date and which administrator made the decision.

9. Children’s Privacy

The Website is only for adults aged 18 and over. Age verification is mandatory before anyone can access member areas or age-restricted content. Despite this, we may occasionally collect information from someone under 18, for example through an attempted registration or a complaint.

If we suspect that an account is operated by someone under 18, we may restrict it while we investigate. If we confirm that an account is operated by a minor, we will close it. Personal information connected with that account will be handled under applicable privacy and retention requirements. We may disclose information to authorities where the law requires it, or where disclosure is otherwise lawful and appropriate.

If you believe someone under 18 is using the Website, contact admin@kinkysydney.com or message @kinkysydney on the Website.

10. Third-Party Links and Services

The Website may link to other websites that we do not operate. Those websites have their own privacy practices, and we are not responsible for them. Please read their privacy policies before giving them personal information.

Some services are built into the Website rather than just linked from it, such as Microsoft Azure AI Vision for age verification and font and code delivery services. These may process personal information when you use the Website. We choose these services, and we describe them in Sections 2.2 and 4.1.

11. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in the law, technology or how we operate. The updated version will be published on the Website with a revised “Last Updated” date. We may tell members about significant changes through a notice on the Website or by email. Where the law requires fresh consent for a change, we will ask for it. Continuing to use the Website does not mean you consent to materially different handling of your personal information.

12. Contact Us
